Telangana High Court Rejects Plea for Aadhaar-Based Voter Verification, Says Judicial Interference Not Permissible

The Telangana High Court has dismissed a petition seeking directions to the Election Commission of India (ECI) to introduce Aadhaar-linked biometric or mobile OTP-based voter authentication systems. The bench comprising Chief Justice Aperash Kumar Singh and Justice G.M. Mohiuddin ruled on Friday that such measures cannot be enforced through judicial intervention, emphasizing that the court cannot dictate administrative or policy decisions to a constitutional body like the ECI. The verdict highlights the court’s consistent stance on maintaining the separation of powers, allowing the Election Commission to independently assess and decide on the viability of any new verification mechanisms.

The bench noted that while technology can enhance the integrity of electoral rolls, implementing Aadhaar-based verification across India remains impractical, given that a section of the population still lacks access to mobile phones or consistent digital connectivity. The judges observed that introducing such a system could inadvertently disenfranchise eligible voters, especially those from rural, economically weaker, or marginalized backgrounds. The court underlined that while digital reforms are desirable, they must not compromise universal suffrage, which forms the foundation of India’s democratic framework.

With this decision, the Telangana High Court reaffirmed the Election Commission’s autonomy and accountability in managing voter identification processes. Legal experts view the ruling as a reminder that constitutional institutions must operate within their designated domains — courts interpret the law, while the ECI governs electoral policy. The judgment also comes at a time when concerns about data privacy, surveillance, and digital exclusion are growing nationwide. The ECI is now expected to conduct its own feasibility study before considering any large-scale technological integration with Aadhaar in future electoral exercises.
