The Telangana High Court has ruled that a Muslim man’s second marriage cannot automatically be treated as the offence of bigamy under Section 494 of the Indian Penal Code (IPC). Justice N. Tukaramji quashed the criminal proceedings against the accused, observing that the legal requirements necessary to invoke Section 494 IPC were not fulfilled. The Court explained that, for bigamy to apply, the prosecution must establish the existence of a valid first marriage, a subsequent marriage, and that the second marriage is legally void because the first marriage was still subsisting. Referring to the Muslim Personal Law (Shariat) Application Act, 1937, the Court held that the continued existence of a first marriage alone does not make a Muslim man’s subsequent marriage void.

According to the case records, the complainant stated that she married the accused on February 28, 2009, in accordance with Muslim customs and later alleged that he contracted a second marriage on May 24, 2015, while their marriage was still in force. Based on her complaint, a case under Section 494 IPC was registered in 2021, followed by the filing of a chargesheet. However, the accused’s counsel argued that the first marriage had already been dissolved under Muslim Personal Law before the alleged second marriage, making the charge of bigamy unsustainable.

After examining the investigation records, the High Court found material indicating that the first marriage had been dissolved before the alleged second marriage took place. The Court further observed that even if the first marriage had continued, its mere existence would not automatically satisfy the ingredients of Section 494 IPC in the case of a Muslim man governed by Muslim Personal Law. Holding that the essential legal requirements for prosecuting the offence of bigamy were absent, the High Court quashed the criminal proceedings against the accused, bringing the case to a close.
