Supreme Court Cracks Down on Illegal Commercial Use of Residential Properties

The Supreme Court has ordered authorities across the country to take strict action against commercial activities operating in areas officially designated for residential use. A Bench comprising Justice Ahsanuddin Amanullah and Justice R. Mahadevan directed that properties found violating approved land-use norms should be sealed immediately. The Court clarified that pending ownership disputes or other litigation would not prevent authorities from taking action if the property was being used contrary to its sanctioned purpose. It also stated that completely unauthorized structures may face sealing or demolition in accordance with the law.

The Court stressed that enforcement must be carried out fairly and uniformly, warning officials against adopting a selective or “pick-and-choose” approach. During the hearing, the Bench also expressed serious concern over threats allegedly made against individuals assisting the Court during inspections of coaching centres and other establishments. Taking the matter seriously, the Court initially directed the Rajasthan Chief Secretary and Director General of Police to appear personally and explain the progress of the investigation. However, after the state assured the Court that strict action would be taken within 24 hours, their personal appearance was temporarily exempted.

The Bench also issued a contempt notice to the Chief Secretary of Uttarakhand for failing to comply with earlier directions and reviewed matters related to the Bhopal Master Plan, directing authorities to prioritize stopping commercial activities in residential zones. The Court allowed publication of the draft Master Plan for Bhopal but prohibited its finalization without prior permission. It further ordered authorities in Delhi, Lucknow, and other cities to fully cooperate with inspection teams and submit updated status reports before the next hearing, which has been scheduled for November 23, 2026.
