Delhi HC Rejects Plea to Restore Utilities at Historic Race Course Mosque

The Delhi High Court has refused to direct the restoration of electricity and water supply to the historic Race Course Mosque, a Waqf property located near the Prime Minister’s official residence. The utilities were disconnected earlier this month as authorities continued demolition and land clearance operations in the Race Course Club area. The Central Government has maintained that the land is being taken over due to national security concerns, while also stating that no formal eviction notice has been issued to the mosque, despite the imam’s claim that he was asked to vacate the premises.

The petition was filed by the mosque’s imam, Mohd Haroon, seeking the immediate restoration of essential services. However, the High Court observed that the Delhi Waqf Board, being the original occupant of the property, had not challenged the disconnection. The court further ruled that the imam did not have an independent legal right to claim a violation of his fundamental rights. It also noted that questions relating to ownership, possession, and the legal status of the property involve disputed facts that cannot be decided through a writ petition, leading to the dismissal of the plea.

Meanwhile, the Delhi Waqf Board has urged the NDMC and the Land & Development Office to restore electricity and water while protecting the mosque and its adjoining graveyard. The board stated that the mosque has had a valid electricity connection since 1976 and that the utilities were disconnected without prior notice despite all dues being paid. Political and religious leaders, including AIMIM chief Asaduddin Owaisi and Jamiat Ulama-i-Hind, have appealed to the Central Government to intervene and ensure that no demolition or further action is taken until the legal dispute is resolved.
