“Supreme Court Cracks Down on ‘Bulldozer Justice’: New Guidelines for Demolitions”

The Supreme Court has laid down pan-India guidelines on demolition of properties, stating that the Executive cannot become a judge, declare an accused as guilty, and demolish their house.ยน The bench, comprising Justices B R Gavai and K V Viswanathan, deemed it “totally unconstitutional” to demolish houses of people merely because they are accused or convicts.

The court directed that no demolition be carried out without prior show cause notice and within 15 days from the date of the notice being served. Additionally, proceedings of demolition shall be videographed. These directions do not apply to unauthorized construction on public land or court-ordered demolitions.
