Delhi HC to Hear Umar Khalid’s Bail Plea on Monday

Umar Khalid, a former JNU scholar and student activist, has been behind bars since September 2020 under the Unlawful Activities Prevention Act (UAPA) in connection with the 2020 North-East Delhi riots. The Delhi High Court is set to hear his bail plea on Monday, October 7, with Justices Navin Chawla and Shalinder Kaur presiding over the matter [1).

Khalid’s lawyer has posed a critical question to the court, asking whether sharing messages constitutes a terrorist act. This comes after Khalid’s previous bail applications were rejected by both the trial court and the Delhi High Court. In February, Khalid withdrew his special leave petition filed before the Supreme Court seeking bail due to a “change in circumstances” [1).

The hearing on Monday will be a significant development in Khalid’s case, who has been in custody for over four years. The court’s decision will be closely watched, especially given the context of the 2020 Delhi riots and the charges leveled against Khalid under the stringent anti-terror law UAPA and various sections of the Indian Penal Code (IPC) ¹.
